This Privacy Policy forms part of Minari's General Terms and Conditions of Sale and Use, and each term defined therein has the same meaning in this Privacy Policy.

In connection with your use of our Website and Software, we may collect various categories of Personal Data, including:

Your Personal Data is collected:

  • Directly from you: when you create your Account, when you contact us through online forms or by phone, or at events.

  • Through third-party partners: we may receive information from our partners or service providers.

  1. Why do we process your Personal Data?

We only use your Personal Data in cases provided for by applicable regulations:

  • Your consent to the use of your data;

  • Performance of a contract relating to your use of the Software or pre-contractual measures;

  • Compliance with a legal obligation;

  • Our legitimate interest, in particular to carry out prospecting or promotional activities for our services, in strict compliance with your rights.

 We retain your Personal Data for a limited period of time, as necessary for the purpose pursued:

  • We retain information relating to Account management, orders, billing and payments for 10 years after the end of the Subscription.

  • We retain information relating to the creation and management of contact lists for 3 years from the last contact from the prospect.

  • We retain recordings of telephone calls between you and our sales teams for a period of six (6) months.

  • We retain connection data from your use of the Software for 1 year.

  1. Who has access to your Personal Data?

The Personal Data collected remains strictly confidential and is only accessible to the following categories of recipients:

  • Our employees and staff members in the performance of their duties;

  • Our service providers (hosting, maintenance, CRM tools, payment solutions, email service providers, telephony infrastructure providers, monitoring and error detection tools, call transcription tools, customer support tools, artificial intelligence service providers).

We may also be required to disclose your Personal Data to a third party if compelled to do so by law, regulation, or court order, or if such disclosure is necessary for the purposes of an investigation, injunction, or legal proceedings initiated by a national authority, whether in France or abroad. 

We guarantee that we do not sell or rent your Personal Data to third parties.

  1. Are your data transferred outside the European Union?

The infrastructure supporting the Minari Software is located in France. However, where necessary, we may transfer certain Personal Data to service providers operating outside the European Union. In such cases, we ensure in advance that appropriate safeguards are in place to govern any Personal Data transfer (such as the European Commission's Standard Contractual Clauses), in accordance with the GDPR.

  1. How do we protect your Personal Data?

We take all necessary measures to ensure the security of your data and to prevent loss, misuse, intrusion, unauthorised disclosure, alteration or destruction of the Personal Data you provide to us. The security measures implemented may be organisational or technical in nature, and their implementation is based on a risk-based approach.

  • Stored data is protected by AES-256 encryption, in line with the strictest security standards.

  • Regular backups are performed to ensure the availability and integrity of your data in the event of an incident.

  • When we engage service providers to process Personal Data, we have verified in advance that these providers guarantee an equivalent level of security protection.

In accordance with applicable regulations, Minari guarantees the effective exercise of all rights granted to you. You may therefore:

  • Access your Personal Data;

  • Rectify inaccurate Personal Data concerning you;

  • Obtain the erasure of your Personal Data;

  • Restrict our processing of your Personal Data;

  • Withdraw your consent to the processing of your Personal Data;

  • Object to the processing of your Personal Data;

  • Obtain a copy of your Personal Data;

  • Define instructions regarding the retention, erasure and communication of your Personal Data after your death.
